FALLBROOK (KGTV) -- A couple looking to buy a home in the North County wants to share an experience they're describing as negative as the new solar energy law goes into effect in 2020.The law requires that homes built in California starting in 2020 must have solar panels. It has caused confusion among potential homebuyers, like Brian and Carmen McKay. They recently left Las Vegas, looking to move back to San Diego County.“I used to work at Fallbrook skilled nursing many years ago,” said Carmen McKay. The couple found a home they liked in the Horse Creek Ridge development, a new housing project in Fallbrook.“When we realized it was a corner lot… oh my gosh, we loved it,” Carmen said.They were told the cost was roughly 5,000—which sounded like a reasonable price for San Diego, according to the McKays. That is when they say they got a surprise from the sales representative.“Then she says, by the way, once we were sold on the house and the price… there’s solar panels on the house. You have the option to lease it or buy it. And we’re like, why?” Carmen said.They said during the home tour, solar panels were not mentioned at all. Carmen said the sales representative only mentioned it when they were back in the office, ready to sign documents to buy the home. As the McKays were questioning solar, they were told “it’s required by the state.” That is only partially true. A spokesperson for the California Energy Commission told Team 10 that “the law only applies to homes that have been permitted after Jan. 1, 2020.”“If that’s not the case with the home in question that you mentioned, then the mandate does not apply,” wrote energy commission spokesperson Edward Ortiz.The McKays were told it would be about ,000 extra to buy the solar panels.“I think that it was misleading because we were buying a house that we were told it was 5, but it’s actually 5 or we’re paying a higher monthly out of pocket,” said Brian McKay.The seller knew they were on a time crunch.“We sold our property [in Nevada]. We’re at an AirBnB… we need to buy,” Carmen added.Nobody at the sales offices at Horse Creek Ridge would comment. Team 10 was directed to public relations. Through email, the spokesperson said:“Two separate state energy requirements guide D.R. Horton in its decisions regarding home design options in the state of California – the current State Energy Code requirements (commonly known as Title 24) and the State‐Mandated Solar requirements, which take effect in 2020. In most communities, we have found that solar is the best, most cost‐effective option for both D.R. Horton and our homebuyers to meet the current Title 24 Energy Code requirements. Thus, Horse Creek Ridge was designed using solar to meet the current Title 24 requirements, and as a result, we are required by the state to have solar on each home in the community.”When asked why that was not told to the potential homebuyers from the beginning, during the tour of the home, D.R. Horton spokesperson added that “solar requirements are communicated to customers via numerous marketing materials… and as an addendum to the home purchase agreement.” She pointed to an 8-page brochure, where solar is mentioned once on page 7. She also sent Team 10 an image of solar displayed on a model home—something the McKays said they never saw.There is no mention of solar or photos of any homes with solar on Horse Creek Ridge’s website. “I feel like I was deceived,” Carmen said. “We fell in love with the place. I felt like I was pushed in the corner.”Dan Zimberoff is an attorney not involved in this case, but he has seen solar disputes in the past. “A buyer needs to be aware,” Zimberoff said. “If you’re purchasing a new home and you see what that price is, ask the details. Is that really going to be the final price?” “We’re starting to remember why we left California,” Carmen said.The McKays ultimately decided not to buy the home. They hope their experience teaches others about the right questions to ask. “We were willing to pay the higher cost to live here, but I don't like being misled by builders,” Brian said. ESCONDIDO, Calif. (KGTV) -- Escondido Police are investigating after a man was stabbed to death Tuesday evening.Police say there were called to the 500 bloc of West 7th Avenue just before 8 p.m. Tuesday afte receiving several reports of a man in an alley who was unresponsive.After officers arrived, they found the man with multiple stab wounds to his upper torso. The man died at the scene, police say.A search warrant was executed at a nearby home believed to be linked to the homicide, but police are still seeking information on the incident and suspects.The events leading up to the stabbing are also unclear at this time.Anyone with information about the homicide is asked to call the Escondido Police Department. 727

Even though Jacob Walter Anderson was indicted on four counts of sexual assault, the ex-fraternity president won't spend a single day in prison.Instead, a plea agreement allowed the former Baylor University student to plead no contest to a lesser charge of unlawful restraint.If the 24-year-old successfully completes three years of deferred probation and pays a 0 fine, his criminal record will be wiped clean of the charge, and he won't have to register as a sex offender, CNN affiliate KWKT said.The plea agreement between Anderson's defense team and the McLennan County, Texas, district attorney's office infuriated the victim and her attorney."The evidence is incredible," Vic Feazell, the woman's attorney, told KWKT. "He nearly choked her to death. He raped her violently. He left her passed out in her own vomit -- the rape exam confirmed rape."The incident happened February 21, 2016, the woman said, according her victim impact statement posted on KWKT's website.She lambasted the court for accepting the plea agreement."I am devastated by your decision to let my rapist Jacob Walter Anderson go free without any punishment," the woman said."He is now free to roam society, stalk women and no one will know he is a sex offender. Jacob Anderson and all rapists who get away with their crimes will never be cured, never change. If anything they will be emboldened by their power over women and their ability to escape justice and punishment."Details of the alleged sexual assault were redacted from an arrest warrant affidavit. But shortly after Anderson was charged with sexual assault in 2016, a Waco police spokesman spelled out details from the police reports."The female said that she had been at a party at a fraternity in South Waco. She said she was handed a drink of some kind of punch and was told, 'Here you go. Drink this,' " Sgt. W. Patrick Swanton said, according to a March 2016 story in the Waco Tribune-Herald."She said shortly after that she became very disoriented, was taken outside by our suspect, who is Jacob Walter Anderson, and she said when they got outside, Anderson forcibly sexually assaulted her."In her victim impact statement, the woman said Anderson "repeatedly raped me orally and (vaginally).""When he forcefully picked me up and shoved me into a wall to rape me vaginally from behind he calmly and coldly said, 'It's fine. You're fine.' When I tried to pull up my pants or sit he shoved me to the ground and shoved his penis back down my throat and continued to choke me," the woman said."When he forced me up again and started to rape me vaginally again I blacked out permanently. When I was completely unconscious he dumped me face down in the dirt and left me there to die. He had taken what he wanted, had proven his power over my body. He then walked home and went to bed without a second thought to the ravaged, half dead woman he had left behind."As he walked out of the courtroom Monday, Anderson declined to comment to the media.CNN reached out to Anderson's defense team and the victim's attorney Tuesday, but has not received responses.The McLennan County District Attorney's Office said the person handling all media inquiries, Rebecca Akins, is out sick Tuesday. Evacuations have been ordered for northern Arizona communities due to the Tinder Fire burning near Happy Jack.According to Coconino County officials, evacuations were ordered Sunday by the Coconino County Sheriff's Office for affected communities north, east and west of Highway 87 including Moqui Ranchettes, all of Starlight Pines, Clear Creek (except 1 and 2), all of Timber Ranch, all of Tamarron, Pine Canyon, Blue Ridge Estates, Ponderosa Pines, and Mogollon Ranches. The evacuation will be in effect until further notice, deputies will stay in the area to provide 24-hour security.
