TAMPA, Fla. -- A woman who visited Hamburger Mary's in Tampa is suing the establishment for .5 million after she says she was injured by a drag queen's breast while at dinner with friends in 2015.Neldin Molina says she was with friends and family at the restaurant for dinner to celebrate a friend's birthday on May 30, 2015, according to the complaint. The suit says this was the first time Molina had ever visited the restaurant in Tampa. She claims when she entered the establishment, she didn't see any signs of any special events.She was eating her fish n' chips dinner at approximately 8:45 p.m. when she heard music and heard someone begin to speak and then the crowd cheered and clapped. She turned her chair around to see what was going on and saw a person dancing on the stage that was in the restaurant behind her to the left. She started watching and overheard another table say that the drag queen show was starting.At approximately 9:40 p.m., Molina turned around and saw performer Amanda D'Hod point at her and start to walk toward her table. Molina claims she immediately turned around to ignore the performance. A few minutes later, Molina felt someone touch her shoulders from behind her.According to the complaint, D'Hod walked in front of Molina and unexpectedly grabbed Molina's head and "wiggled her breast against the Plaintiff's face and head 8 times." D'Hod reportedly grabbed Molina's face and pushed it to the left and right before "violently pounding" it against D'Hod's chest "up to nine times." The complaint says Molina let a restaurant manager know that she was in "excruciating" pain and she was getting a headache and she filed a complaint. The manager told Molina he would notify and give the complaint to the owner who was not currently at the restaurant. Molina later went to the emergency room at Memorial Hospital of Tampa for "excruciating cervical pain and uncontrollable headaches."The manager called Molina weeks later and gave her Insurance information for her to follow up on the complaint. Molina is seeking .5 million for medical costs and expenses for the past, present and future, including the pain and suffering she physically and mentally endured. The complaint also states that Hamburger Mary's failed to advise anyone of the possible dangers while dining at the restaurant.   2431

Survivors of alleged sexual abuse at the hands of priests nationwide are set to announce a federal class-action lawsuit aimed at the United States Conference of Catholic Bishops.In the lawsuit, the group and their attorneys say the Conference "knowingly concealed" the identities and actions of known abusers. TALLAHASSEE, Fla. — A Florida judge sided with a state teacher's union Monday in ruling that the Florida Department of Education could not require all brick and mortar schools to open by the end of the month or lose funding.Leon County Circuit Judge Charles Dodson ruled in favor of the Florida Education Association (FEA), in a lawsuit meant to stop the Education Department's order that would require all schools in the state to reopen for in-person classes by Aug. 31 or face loss of funding. The union filed their lawsuit shortly after the mandate was issued on July 6, claiming the order was in violation of the constitution's safe and secure public education guarantee.The FEA said Monday's ruling is a victory for schools all around the state of Florida."It is a pushback on reckless disregard on human life," said Randi Weingarten, the president of the American Federation of Teachers. "It is a pushback on politics overtaking safety and the science and the well being of communities."Fred Piccolo, a spokesperson for the governor's office, said the state intended to appeal the ruling."We intend to appeal this ruling and are confident in our position and in the authority of the Commissioner and the Governor to do what is best for our students," Piccolo said.The legal team for the FEA says the state can appeal, which would mean an automatic stay in the ruling given Monday. The battle over the sale of the Confederate flag at the Lorain County Fair reached yet another peak after a vandal posted a Confederate flag on a billboard protesting its sale.The billboard is one of three purchased by the Fair Minded Coalition of Lorain County which urges residents to "say no" to the sale of the Confederate flag at the fair. Coalition member Jeanine Donaldson said she believes someone posting the flag on a coalition billboard is further proof of how it divides a community."To my family and other African-Americans it symbolizes hate, torture and terror," Donaldson said. "It's a right and wrong situation in the year 2018.""No less than Governor John Kasich was the one who recommended that the flag come down for the state fair, and he did it because it was the right thing to do," she saidLorain City Councilman Angel Arroyo said the Lorain County Fair Board needs to finally ban the sale of the Confederate flag because it doesn't represent Ohio or his community."It's a sign of ignorance and hatred of people in our community," Arroyo said."It's frustrating putting this flag on the billboard.  It's a sign of disrespect and truly shows the true colors of racism and hatred."But Lorain County Fair Board President Kim Meyers says the Confederate flag has been sold at the fair for 30 years. Currently, it's being sold by one vendor who is selling the flag as part of a wide variety of Civil War memorabilia.Meyers said to restrict the sale of the flag would be a violation of First Amendment rights."Here at the fair, probably 99 percent of the feedback that we received has been in favor of the fair allowing for the sale," Meyers said."The Ohio Fair Managers conference back in 2016 voted unanimously, there were 88 counties and seven independent fairs, that voted to allow the sale of that."Still, Donaldson said her group will continue to protest, and said more efforts to stop the sale of the Confederate flag at the fair will be unveiled in the coming months."We're not going away," Donaldson said."This is not about politics, it's just the right thing to do."    2159
