SAN DIEGO (AP) — A Navy SEAL committed murder during a deployment to Iraq and the proof is in his own words, his own photos and the testimony of his fellow troops, a military prosecutor told a jury Monday.Cmdr. Jeff Pietrzyk said in closing arguments of a court-martial that text messages by Special Operations Chief Edward Gallagher show he is guilty of fatally stabbing a wounded Islamic State prisoner on May 3, 2017.One message said: "I've got a cool story for you when I get back. I've got my knife skills on." Another text stated: "Good story behind this. Got him with my hunting knife."As he showed a photo of the dead prisoner with Gallagher holding up his head by the hair, the prosecutor said, "Those are his words."The prosecutor said one SEAL who changed his story and claimed to have killed the prisoner himself was lying to protect Gallagher."The government's evidence in this case is Chief Gallagher's words, Chief Gallagher's pictures, Chief Gallagher's SEALs," Pietrzyk said.The prosecutor said he wouldn't try to argue sympathy for the teenage prisoner, who had been wounded in an air strike."Before the air strike, he would have done anything in his power to kill an American," Pietrzyk said.But he said the prisoner was not a lawful target."We're not ISIS. When we capture someone and they're out of the fight, that's it. That's where the line is drawn," Pietrzyk said.Gallagher, 40, has pleaded not guilty to murder and allegations that he shot civilians and a violation involving posing with the corpse for photographs.Defense lawyer Tim Parlatore began his closing argument the same way he started the trial. "This is case is not about murder, it's about mutiny." Parlatore said.The attorney said there's no body, no forensics, and the SEALs who testified against Gallagher lied because they didn't like his demanding leadership.Parlatore also addressed the testimony of Special Operator Corey Scott, who said he saw Gallagher stab the prisoner in the neck but stunned the court when he said he was the one who ultimately killed the prisoner by plugging his breathing tube with his thumb as an act of mercy.The defense attorney contended that investigators never asked Scott about the cause of the death, which is why they were surprised by his testimony."They didn't even listen to their own witness," Parlatore said.A jury of five Marines and two sailors, one a SEAL, will weigh whether Gallagher, a 19-year veteran on his eighth deployment, went off the rails and fatally stabbed the war prisoner as a kind of trophy kill.During the trial, it was revealed that nearly all the platoon members readily posed for photos with the dead prisoner and watched as Gallagher read his reenlistment oath near the body in an impromptu ceremony.Nearly a dozen SEALs testified over two weeks. Most were granted immunity to protect them from being prosecuted for acts they described on the stand.Seven SEALs said Gallagher unexpectedly stabbed the prisoner, moments after he and the other medics treated the 17-year-old boy. Two, including Scott, testified they saw Gallagher plunge his knife into the prisoner's neck.An Iraqi general who handed the wounded prisoner to the SEALs testified that Gallagher did not stab the boy. And Marine Staff Sgt. Giorgio Kirylo said after the militant died that he moved the body to take a "cool guy trophy" photo with it and saw no stab wounds on his neck.Lt. Jacob Portier, the officer in charge, has been charged separately for overseeing the reenlistment ceremony and not reporting the alleged stabbing. 3561

SAN DIEGO — A San Diego-based stem cell research institute believes its discovery may have saved the life of a COVID patient on death's doorstep.GIOSTAR infused a 53-year-old man in a coma with Mesenchymal stem-cells taken from an umbilical cord. GIOSTAR got special clearance from the Food and Drug Administration to try the stem-cell treatment. Srivastava said the patient began to recover, gradually over three weeks. "Slowly, his renal and liver function came closer to normal," he said. "He came out from the intubation, and now he is talking."The family, in an interview with GIOSTAR, said they had lost all hope. Srivastava said this treatment could be key as society awaits a vaccine. GIOSTAR is planning to do a double-blind study to confirm its conclusions about its treatment. SAN DIEGO (AP) — More than 30 migrants have tested positive for influenza at a major processing center where a flu-stricken teenage boy died, the latest evidence of growing public health threats posed by inadequate facilities to deal with a surge of families and children reaching the U.S. border.It was unclear if anyone ill came in contact with a 16-year-old Guatemalan boy who was held at the facility in McAllen, Texas, and died Monday, a day after he was diagnosed and transferred to a smaller station. Carlos Hernandez Vasquez was detained for six days, twice as long as generally allowed by U.S. law.The processing center is a converted warehouse that holds hundreds of parents and children in large, fenced-in pens that gained international attention last year when it held children separated from their parents. The government closed the facility after the flu outbreak, sent in cleaning crews to disinfect the building and plans to reopen it soon.RELATED: Border officials say migrants from Texas being transferred to San DiegoThe 32 sick children and adults have been quarantined at a smaller processing center, according to a U.S. Border Patrol official who spoke with reporters on condition of anonymity because there is an ongoing investigation. Kevin McAleenan, the acting Homeland Security secretary, came under withering criticism Wednesday from a Democratic lawmaker who called the administration's actions with children "inhumane."The Department of Health and Human Services, which cares for unaccompanied migrant children, said Wednesday that a 10-year-old girl from El Salvador died last year after being detained by border authorities in a previously unreported case. It will loan tents to the Department of Homeland Security, which will manage the camps.The Defense Department will evaluate six potential sites over the next two weeks: Tucson and Yuma in Arizona and Tornillo, Donna, Laredo and Del Rio in Texas. Tornillo, near El Paso, is where unaccompanied children were housed last year.The Pentagon said military personnel will only erect the tents and won't be involved in operations.The 77,000-square foot (7,155-sq. meter) processing center in McAllen is modeled after a similar facility in Nogales, Arizona, built for an influx of Central Americans in 2014. It has separate pods for boys and girls who came alone and parents with their young children.Some older children are split from their parents to avoid having them mix with much younger children.Texas's Rio Grande Valley, which includes McAllen, is the busiest corridor for illegal crossings. The Border Patrol made 36,681 arrests in the area in April, nearly three of every four coming in family units or as children traveling alone.Border Patrol agents have averaged 69 trips to the hospital a day since Dec. 22 and about 153,000 hours monitoring detained population at hospitals, the official said.Authorities have also cleaned other holding facilities in South Texas, including Brownsville, Corpus Christi, Kingsville and highway checkpoints.Migrants are not being vaccinated at Border Patrol stations, but they may be when hospitalized, the official said. SAN DIEGO — It appears the Congressional seat vacated by Republican Duncan Hunter will remain in Republican hands, according a new scientific poll.The ABC-10 Union-Tribune scientific poll shows Republican Darrell Issa leading Democrat Ammar Campa-Najjar 51 percent to 40 percent, with 9 percent undecided. The poll, released Tuesday, has a margin of error of 5.7 points. It comes after the two prior polls showed the candidates in a virtual tie for the 50th Congressional District, which comprises most of East County and stretches into southern Riverside County. The shift came because independents moved to support Issa. Last month, the poll showed Campa-Najjar leading Issa in independents by 13 points. Tuesday's poll showed a major swing, with Issa leading among independents by 14 points. That's a 27-point swing. "In the end, independents in red-leaning area tend to be more red leaning, vice versa for blue-leaning areas, and so it's not surprising that Darrell Issa, as we get closer to the election, is bringing home these independents out in East County, San Diego," said Thad Kousser, political scientist at UC San Diego.The 50th District is the county's last in which Republicans outnumber Democrats in registration, giving Issa the advantage.In an interview Tuesday, Issa said he was traveling the district from Temecula to Jamul, meeting voters with social distancing. "I think my 18 years of support for pro-business, pro-50th type voting has allowed me to whether some pretty egregious claims of, somehow, corruptness and so on," he said. Campa-Najjar declined an interview Tuesday, but released this statement: “I’m inviting voters to reach me personally at 619-721-5148. The only poll that matters is on Election Day, and CA-50 voters have defied the odds time and time again. Darrell Issa is trying to buy and lie his way back to Congress. But CA-50 voters know me, I’ve spent the last four years listening to their needs. And I know that in one week, voters will show the world what I’ve seen over the past four years.”In response to that statement, Issa said, "It's a statement of somebody who is way behind in the polls, not likely to win, and somebody who spent more money and went negative claiming that, somehow, I was unfit from day one."SurveyUSA polled 538 likely voters in the district from Oct. 22 to Oct. 26. 2348
