He alleges negligence, premises liability, assault, battery and intentional infliction of emotional distress.A Denny's representative did not immediately reply to a request for comment on the complaint brought Friday. The plaintiff is seeking unspecified compensatory and punitive damages.According to his court papers, Martinez was having dinner alone at the Denny's in the 800 block of South Figueroa Street on June 24, 2018, when a homeless man entered the location and "immediately began making racial slurs at other customers and began harassing the other customers."The homeless man then approached Martinez and began hitting him before stabbing him several times with a knife, according to the lawsuit."At no point in time did defendant's staff intervene or even ask or escort the homeless man to leave," the suit says.Denny's did not have any security guards at the restaurant even though management knew of previous violent incidents there, the suit alleges. 1306

  

LOS ANGELES (AP) — Deputies arrested a 13-year-old boy and seized a semi-automatic rifle after he threatened to shoot other students and staff at a Los Angeles-area middle school, authorities said Friday.In a separate case, a boy at another school was taken into custody involving a planned shooting.The arrests came barely a week after deputies were frantically summoned to a high school in Santa Clarita, where a 16-year-old boy killed two fellow students and took his own life.Since then, the Los Angeles County Sheriff’s Department has investigated at least 30 school threats, spokesman Sgt. Duncan Hunter want a federal judge to reject an attempt by prosecutors to introduce evidence that the congressman used campaign funds to finance a string of extramarital relationships, a court filing said Friday.Prosecutors are seeking permission "to focus the jury's attention on Mr. Hunter's infidelity" with evidence that isn't necessary for a jury to evaluate the case, they wrote. To allow it would present "substantial risk of unfair prejudice."Allegations about the married Republican congressman's affairs were outlined in a government court filing Monday, connected to charges he and his wife illegally spent more than 0,000 in campaign funds on trips, meals and other personal expenses.Prosecutors are seeking permission to introduce details of the romantic affairs in U.S. District Court in San Diego, which they say are necessary to "demonstrate Hunter's ... intent to break the law and to establish his motive to embezzle from his campaign."Margaret Hunter pleaded guilty this month to one corruption count.
