SAN DIEGO (CNS) - A San Diego man was sentenced Friday to more than six years in prison for operating a million Ponzi scheme that caused investors to lose more than million.In addition to the 75-month sentence, Jonny Ngo, former president and CEO of NL Technology, LLC, was ordered to pay nearly million in restitution for bilking investors out of money he alleged would be used to fund wholesale purchase orders of smartphone screens and other electronic goods.Prosecutors said the funds were actually spent on personal expenses, such as "a home, luxury cars and gambling."Ngo, 34, told investors that NL Technology was supplying smartphone screens to several buyers, including two that each ordered about million worth of NL Technology products, and prepared false financial and bank statements to back up his claims, according to the U.S. Attorney's Office.Ngo pleaded guilty to a mail fraud charge last year."Ngo swindled and conned innocent investors out of their hard-earned money to support his lavish lifestyle," FBI Special Agent in Charge Suzanne Turner said. SAN DIEGO (CNS) - A man who wounded an off-duty sheriff's deputy and a bystander by opening fire in the Gaslamp District two years ago was convicted of assault with a firearm Thursday in his third trial in the case. Ray Pitoau, 39, was convicted of two counts of assault with a firearm for the Aug. 7, 2017 shooting that injured Deputy Jason Philpot, who was walking through downtown with his two brothers following a Metallica concert at Petco Park. Also injured was bystander Vladimir Shvets, a passerby in San Diego for a convention. Pitoau was also convicted of a lesser charge of assault on Philpot's younger sibling, Joshua, who Pitoau initially got into an argument with on Island Avenue near Sixth Avenue just after 1 a.m. RELATED: Gaslamp deputy shooting suspect escapes Spring Valley SWAT standoffSentencing is scheduled for Dec. 11. Pitoau was convicted in a prior trial of three felony firearm possession counts and was sentenced to 27-years-to-life for those convictions. However, both of his previous trials in the case resulted in hung juries regarding the assault charges. Jason Philpot testified that he tried to wrap his arms around Pitoau and get the gun away, but the defendant was able to pull the trigger, wounding the deputy in the chest and right arm. A second round also passed through his right arm. One of the rounds ricocheted off the sidewalk and struck Shvets. Pitoau testified that he grabbed a gun in self-defense because a group of men, including Philpot, were advancing on him. He testified that he and Jason Philpot both grabbed onto the gun, leading it to fire as they grappled over the weapon. SAN DIEGO (CNS) - After being reassured that motorists' privacy would not be compromised, the county Board of Supervisors Wednesday unanimously approved a plan to electronically collect license plate data as part of a vehicle- emissions study aimed at improving air quality.Under the plan, the county Air Pollution Control District will use automated license reader software to analyze vehicles at 12 intersections in disadvantaged communities, including Barrio Logan, Logan Heights, Sherman Heights and western National City.A state grant will pay for the ,500 automated license plate reader system, which will collect license plate numbers and vehicles' weight, make and model.Jon Adams, assistant director of APCD, said the data will be collected in a secure method and kept at the district office, and would not be shared with anyone else. He said information, including license plate numbers, will be deleted after three days.Other agencies, including the California Air Resources Board and Port of San Diego, already use the same software, Adams said.APCD officials met over the last two months with various community groups and the Portside Community Steering Committee, which includes representatives of private and public organizations.The district's Community Air Protection Program was developed in response to Assembly Bill 617, which is aimed at reducing exposure to air pollutants in disadvantaged communities.At its Sept. 11 meeting, the Board of Supervisors expressed concerns over potential privacy violations and asked district officials to present alternatives.Two residents urged the board to support data collection, saying the end goal of cleaner air is a worthy cause.Sandy Naranjo, a Portside Steering Committee member, said "information and transparency are crucial for our communities, because we are tired of getting sick."Joy Williams, an Environmental Health Coalition member, said her group has been working in Barrio Logan and surrounding communities for decades and heard numerous complaints about pollution sources, including mobile ones.Supervisor Greg Cox said any time the county can get so many groups to agree, it's a good sign and "makes it a pretty easy decision on our part."Supervisor Kristin Gaspar said she appreciated the reassurances relating to privacy."I believe that we have the best intentions with this program," Gaspar said.Supervisor Nathan Fletcher said no group of children should be "eight times more likely to develop asthma because of where they live or the color of their skin.""We have to take swift, bold action and spend money in a way that represents the greatest investment," Fletcher said, adding he hopes this program gets underway quickly. 2716

SAN DIEGO (CNS) - In a 6-3 vote, the San Diego City Council today rejected a proposed .5 million sale of the property holding the city's only roller skating rink, Skateworld.The proposal called for the city to sell the parcel of land to big-box store developer Pacifica Companies, much to the chagrin of Skateworld supporters who called on the council to either collect more community feedback before approving the sale or reject it outright in favor of renovating the rink.Skateworld advocates collected thousands of signatures in an effort to save the skating rink, including a change.org petition that garnered more than 19,000 supporters. "I really appreciate that residents of every council district came to speak today about the community that Skateworld fosters,'' said City Councilwoman Barbara Bry. "I think there's so few family friendlyopportunities in that community that it's really essential.''The skating rink was developed under a state redevelopment agency more than 40 years ago. When Gov. Jerry Brown dissolved the redevelopment agencies in 2011, he ordered that their assets be liquidated to the highest bidder.The city put the property up for bid last year and named Pacifica the recommended buyer after three rounds of receiving offers for the site. Supporters of the sale, including City Councilman Scott Sherman, who represents the district Skateworld is in, argued the city's hands were tied and it should honor Pacifica's bid. City Council members Mark Kersey and Chris Cate also voted in favor of the sale."I have to try to make a decision on what is fair,'' Sherman said. "And the reality is, if we went through three rounds of bidding and everybody was aware and we went through the community outreach and all that process andSkateworld had won that bid and I came in and said, `No, the developer said they'll give us more money, just tell them what they have to beat' ... everybody in this room would be down here screaming `How dare you do that.'''After rejecting the sale, the council voted unanimously to shift the property from a liquidation designation to a future redevelopment site. But he voted for the motion regardless. "When I was looking at this, I really did say, you know, I like to give deference to my fellow council members and their district,'' City Councilwoman Monica Montgomery said. "This though, I went to church down the street as a child and went to Skateworld, so it is something that affects all of us.''The technically nonpartisan council voted along party lines to avoid the sale, showing the influence of council Democrats' supermajority. SAN DIEGO (CNS) - Authorities Monday publicly identified a 39-year-old firefighter killed over the weekend in a suspected DUI motorcycle crash near Lakeside.Ryan Ferrara, an engineer with the San Diego Fire-Rescue Department, was riding on the back of a westbound 2018 Harley-Davidson that crashed into a parked vehicle in the 13000 block of Piping Rock Lane about 9:30 p.m. Saturday, according to the county Medical Examiner's Office and California Highway Patrol.Ferrara died at a trauma center about an hour later, and the 36-year-old El Cajon resident who had been piloting the two-wheeler was hospitalized for treatment of severe injuries, CHP public-affairs Officer Jeff Christy said.Neither man -- the driver was not publicly identified -- was wearing a helmet at the time of the wreck, according to the Highway Patrol."Alcohol and/or drug impairment is suspected as a factor in the collision, and (it) is still under investigation with possible charges pending," Christy said.In a prepared statement, San Diego Fire Chief Colin Stowell said his and his employees' "hearts are broken by the news" of the death of Ferrara, who had been with the city emergency-services agency for 13 years. 1203
