SAN DIEGO (KGTV) — Jurors were again deadlocked in the retrial of the man accused of shooting two people outside of a Metallica concert in downtown San Diego in 2017.In July, 37-year-old Ray Pitoau had his first trial and was found guilty of three firearm charges, including felon in possession of a gun. But jurors were deadlocked when it came to charging him with three counts of assault with a deadly weapon.On Friday a jury, again, could not reach a verdict on the assault charges against Pitoau.RELATED: 526

SAN DIEGO (KGTV) - Local VFW posts are bracing for the new restrictions to kick-in on Saturday.The restrictions result from an increase in COVID-19 cases in the county, putting the county in the state's purple tier, the tier with the toughest covid-19 related restrictions.Mike Hill, the post commander at VFW 5985 in Pacific Beach, says they are already struggling to make ends meet during the pandemic because of the restrictions."There are 22 VFW posts and more American Legion posts through San Diego County, and all of us rely on having events and having people coming to our canteen, which is sort of military for a bar and spend money there, and that helps support us," Hill said. "We've eaten up most of our savings to pay the bills while we've been closed."He says they have relied on donations so far and will be needing more the longer the pandemic lasts."I will tell you the members, and I will be dialing for dollars," Hill said. He says they will start within their members first, then the community."We'll reach out to the community and hope that some of them will value this place that's been in the community for 90 years and let it still be a home for veterans to be around other veterans," he said.VFW 5985 has been closed most days except Tuesdays and Fridays to make meals for dozens of veterans, their families, and those who need it. SAN DIEGO (KGTV) - Lupus patients were shocked and scared when they found out they couldn't get a refill of their life-altering prescription, due to COVID-19.Grandmother Michele Fumar said her daughter has had lupus, an autoimmune disease, since she was 11. She's 27 now, married with two young kids.Her daughter got an email from Kaiser Permanente reading in part, "in order to keep an essential supply of hydroxychloroquine (Plaquenil) for critically ill COVID-19 patients, we have placed a temporary freeze on refills."She was just shocked, we were all shocked," Fumar said about reading that email. "This drug is very important to maintain her health so yes it is just very frustrating."The kind of lupus her daughter has attacks her kidneys. Even while taking her prescription she's had complications. Fumar said her daughter became ill at the mall several years back, suddenly weak with a headache. That trip to the emergency room turned into a week long hospital stay.Fumar said her daughter has been trying to wean off of the medication with no luck thus far. "She only has 16 days left of her prescription." Now they're both scared. Her daughter was told to space out the medication, but they don't know how that will affect her health.Janae Lessnau was just diagnosed with lupus in January. On average it takes six years to get diagnosed with lupus, meeting several criteria from several specialists, the Lupus Foundation says.Lessnau said the drug has already had a huge impact on her life, "it helps with fatigue, it helps with the joint pain. It's not really affecting my kidneys or any vital organs right now but not being on it, it could increase the spread, you know increase the process."Lessnau said she felt lucky to pick up her monthly prescription Tuesday at CVS. She heard at the pharmacy she won't be able to get a refill in the future.In contrast, CVS put out a statement reading in part, "With client consent, CVS Caremark is setting appropriate limits on the quantity of each of these medicines for potential use in treating COVID-19. Members who already take these medicines for approved uses will be able to bypass the new quantity limits.""We all feel bad for the patients who may be suffering from COVID-19 but it's not a proven solution," Fumar said. Lessnau agreed adding, "when did we get to the point where we pick and choose lives?"The Lupus Foundation is contacting politicians in Sacramento for help, hoping to find a solution."Right now, today we can't say yes there is a shortage, I don't believe that's true. But what I am afraid of is it will be very quick, because if people are hoarding the drug it will turn out to be like the toilet paper," Executive Director of the Lupus Foundation Southern California Division Elizabeth Savage said.After reaching out to Kaiser Permanente they said they are re-evaluating their policy. 2874

SAN DIEGO (KGTV) -- Mayor Kevin Faulconer has directed city staff to reinstate San Diego Fire-Rescue Department’s Girls Empowerment Camp that was abruptly canceled last week.The event was canceled one day after attorney Al Reva sent a letter to the city’s attorney and organizers of the event.The letter claims that Reva’s client Rich Allison was “deterred and prevented from timely enrolling his son in this camp because boys were not invited to attend, based solely on their sex.”RELATED: Girls empowerment camp rescheduled after abrupt cancellation?Families who previously registered for the canceled camp will have first choice of which of the two weekends the camp is being offered they would like to participate in.“Our firefighters, staff and volunteers put their hearts and souls into this event,” said Fire Chief Brian Fennessy. “We are committed to moving forward with this excellent opportunity for young people. Last year, we heard that the Girls Empowerment Camp was a priceless experience for the campers. We want the same for our 2018 participants.”The Girls Empowerment Camp is a free two-day camp for youth ages 14-18 “regardless of age or gender.”The camp introduces participants to career opportunities in firefighting and encourages them to consider public safety as a career option.“We made a commitment to hundreds of kids and their families and we are going to stand by that,” Mayor Faulconer said. “This is an important camp that teaches kids what it’s like to be a firefighter and exposes many of them to a career opportunity they may not have considered previously. SAN DIEGO (KGTV) -- Iconic TV host Regis Philbin, who has roots in San Diego television history, has died at the age of 88, multiple news outlets report.According to a family statement obtained by PEOPLE, Philbin passed away from natural causes Friday night.Philbin returned to his roots in 2018 with a visit to 10News.After a stint in the United States Navy, he moved to San Diego where he launched a career in broadcast. The icon was briefly a news anchor in San Diego when Channel 10, at the time known as KOGO, approached him about taking over as an anchor of the evening news.PHOTOS: Former 10News anchor Regis Philbin visits the 10News crew"This was the beginning of it all," Philbin said upon beginning his tour. "It really was."Shortly after, Philbin landed his first talk show, "The Regis Philbin Show," which was filmed in the ABC 10News studios where the current newscasts are produced.Philbin acted as his own writer, producer, and show guest booker. He was able to book many top celebrities including Jerry Lewis, Ronald Reagan, Danny Thomas, and Liberace.His talk show, which was produced at the now KGTV studios from 1961 to 1965, aired live from 11:30 p.m. - 1:00 a.m. every Saturday night."The show became a big hit so it was time to go to Hollywood, I guess, so I did," said Philbin.Philbin moved his show to Los Angeles, before being hired in 1967 as the sidekick for a national talk show, "The Joey Bishop Show." That’s how he made you feel. I felt equal to him. It was a special moment for me."And that’s the same way Fred Norfleet described Philbin, who he worked with for years as a stage manager on his San Diego morning show."I’m sure he had a heart for San Diego you now. Everybody knew him. Everybody liked him.
