Prosecutors who dropped felony charges against actor Jussie Smollett over his report of a hate crime attack "have fundamentally misled the public on the law and circumstances surrounding the dismissal," an Illinois lawyers group said.The way Cook County State's Attorney Kim Foxx and her office resolved the case also was "abnormal and unfamiliar to those who practice law," wrote the Illinois Prosecutors Bar Association.The scathing statement, issued Thursday, follows claims by Foxx and her top deputy, Joe Magats, that "alternative prosecution," like the resolution brokered in Smollett's case, is not uncommon and is available to all defendants, celebrity or not. Smollet, 36, agreed to forfeit ,000 bail and complete community service in exchange for the dismissal of 16 charges alleging he'd orchestrated a fake racist, anti-gay attack on himself.Further, Foxx and her office "falsely informed the public" that sealing the criminal case was "mandatory," the prosecutors' organization said. And a special prosecutor should have been appointed when Foxx, citing familiarity with a potential witness, recused herself from the case, the group insisted.Meantime, Chicago's corporation counsel on Thursday asked Smollett to pay 0,106.15 to cover the cost of the investigation into his claims of an attack.Calls for an investigation growSmollett, who is black and gay, told police two men attacked him on January 29, yelling racist and homophobic slurs while striking him, police said. Smollett said the incident ended with a noose placed around his neck and bleach poured on him, police said.Chicago police investigated the case as a possible hate crime, then later said they believed the attack was staged by Smollett to bolster his profile and career. PUEBLO, Colo. — On the afternoon of November 4, 2019, the U.S. Attorney's office announced the arrest of Richard Holzer, a white supremacist who they say had plans to bomb a Jewish synagogue in Pueblo,Colorado, about two hours south of Denver. "We are here today to announce that federal law enforcement, working in conjunction with the Pueblo Police Department, has successfully stopped what we believe to be an imminent threat of domestic terrorism against a Colorado religious institution," authorities said.Authorities say Holzer met up with three undercover FBI agents to purchase bombs in a planned attack against Temple Emanuel, the second oldest synagogue in the state.According to a criminal complaint, FBI agents had been talking with Holzer since September, tracking multiple Facebook accounts of his in which he talked to other white supremacists through private messages about attacking Jewish people. In one message, Holzer said, "I wish the Holocaust really did happen." Holzer told undercover agents he hired someone to poison the synagogue's water supply and was now preparing for a "racial holy war.""Jewish community is tiny in Pueblo," one Colorado woman said. "And we all know each other and support one another and our children."Thirty-five families are part of this small congregation. Michael Atlas-Acuna, the president of Temple Emanuel's board of directors, is still a bit shaken by the plot to blow up a synagogue that was built in 1900. "I looked at the building and the inside, and I thought, 'God, we could have lost this,' " he said.If there's a silver lining to take away from the foiled terror plot, it's that the congregation is now stronger than ever before. It was a packed house at a recent Friday night Shabbat service.The congregation called for peace and happiness, and they said they won't let what happened scare them away. "We're going to be here another 100 years," Atlas-Acuna said. "We're going to take the right precautions that we need to take in order to be safe. Maybe the reason was to wake everybody up and realize that there is that threat out there, and to bring everybody together, and I think the whole community is going to be that much more alert." State Representative Kelly Townsend says she's troubled by video that shows Chandler, Arizona, police officers with guns drawn, forcing their way into a family's home. The officers were there for a 2-year-old boy who was believed to have an extremely high fever. Townsend, a Republican in District 16, played a big role in getting legislation passed requiring the Arizona Department of Child Safety to get a search warrant to remove children from their home in a non-emergency situation. Townsend says she never thought this would be the result."The doctor chose to use DCS to remove the child and DCS chose to use the police and the police chose to use the SWAT team," said Townsend. "That is not the country that I recognize."Townsend says this all started back in February when the parents took the 2-year-old-boy, who isn't vaccinated, to a naturopathic doctor for a fever of about 105. The doctor instructed the parents to take the infant to the emergency room but after the doctor's visit the child's fever broke, so they never went.After finding that out, the doctor called DCS which then called Chandler police to check on the child. After the father refused to let police into the home to check on the boy, police came back later with a search warrant and forced their way into the home after the family didn't respond."All because of a fever. A fever! It's absolutely ridiculous," said Nicholas Boca, the family's attorney. "That type of kicking your door in, with guns drawn... it should be reserved for violent criminals.""At that point who now owns control over the child?" asked Townsend. "And it seems like we've given that now to the doctor and the parent no longer has the say or they risk the SWAT team taking all of your children and potentially the newborn."Townsend says she can see both sides on this story: a concerned doctor and protective parents, but she's questioning how it was done and the amount of force used."We need to admit that this situation was a mistake," said Townsend. "There are other situations where there is neglect, there is abuse and that's what we need to focus on."DCS said it's not able to comment on the case specifically because of privacy laws.Townsend said the child actually had an upper respiratory infection, not meningitis like the doctor had feared.The Chandler Police Department says DCS obtained a search warrant and asked for their assistance entering the home, but says they used regular officers and not SWAT officers.The parents are fighting to get their kids back. STEUBEN COUNTY, Ind. – A suspected car thief was arrested after authorities say he was caught using a homemade license plate, drawn in crayon on a paper grocery bag. On Thursday, Indiana State Police say troopers stopped to lend a hand to 20-year-old Joshua Anthony Lewis-Brown when they spotted him stranded along the I-80 Toll Road. Initially, officers found Lewis-Brown tending to a flat tire on a Toyota Corolla. The man said he was unable to change the tire and he was in need of a tow truck. Preparing to oblige Lewis-Brown’s request, police say troopers spotted the suspicious license plate on the car and began to investigate further. Officers ran a check on the vehicle identification number (VIN) and discovered the Corolla had been reported stolen out of State College, Pennsylvania, on Wednesday. They also found that the driver, a resident of Rochester, New York, had never actually been licensed to operate a motor vehicle in any state and was on probation for grand larceny. Lewis-Brown was placed under arrest and transported him to the Steuben County Jail, where he was booked and charged with possession of stolen property and operating without ever obtaining a license. He’ll be held on the Indiana charges before being extradited back to Pennsylvania to face local charges.Police say the stolen vehicle had been left unattended and unlocked with the engine running outside a Pennsylvania grocery store. The owner, wanting to keep his car warming in the cold weather, had run into make a quick purchase, only to find his car missing upon return, according to police. “In light of this particular circumstance, the Indiana State Police would remind all motorists that leaving your vehicle unattended with the engine running and doors unlocked, is never a good idea,” wrote police. “Auto theft is often a common occurrence during the winter months. This is especially true in our urban neighborhoods where we find a higher concentration of residents wanting to warm their cars unattended in the frigid early morning hours prior to the morning commute.” 2081
